Non Reliance Clauses still subject to Misrepresentation

A recent Court of Appeal decision identified that although a non-reliance statement making it clear that a party is not liable for misrepresentation may prevent a contractual claim this does not prevent a misrepresentation claim. 

To do otherwise would render the whole pre-contract conveyancing process worthless. This is a useful reminder on the accuracy of pre-contract enquiries and replies.
